1. The company

LumiPop respects the privacy of its users and recognizes the importance of their personal data.

2. Who processes personal data ?

2.1 Data controller

LumiPop is responsible for the processing and determines alone, or in collaboration with others, what personal data is collected, as well as the purpose and means for processing such personal data.

2.2. Processor(s)

LumiPop is free to use data processors. A data processor is a natural or legal person who processes personal data at the request or on behalf of the data controller. The processor is obliged to guarantee the security and confidentiality of the data. The processor always acts in accordance with the data controller's instructions.

LumiPop uses the following categories of "processors": hosting companies, external payment service providers and logistics partners.

3. What is the legal basis for processing my data ?

In accordance with the Privacy Act and the Regulations, we process personal data on the following legal grounds:

  • On the basis of contract performance as agreed with the User, or the performance of pre-contractual steps, at the User's request ;

or

  • On the basis of compliance with legal or regulatory provisions relating to the management of the contractual relationship, and in particular invoicing ;
  • On the basis of our legitimate interest in sending information and circulars to our customers ;
  • On the basis of your explicit consent to the sending of promotional offers (direct marketing).

4. What personal data is processed ?

LumiPop undertakes to collect and process only personal data that is relevant and necessary to achieve the purposes for which it is processed. The following categories of personal data are processed:

  • Personal identification data (surname, first name, address) ;
  • Contact details (telephone number and e-mail address) ;
  • Financial identifiers (Banking data: we only keep the data we need, and always in compliance with the RGPD);
  • Electronic identification data (IP address, location, cookies) ;
  • Optional personal data (gender, date of birth).

This data is collected when you register on the Website and/or place an order. Data may also be provided to external partners, subject to your authorization. Other personal data may be collected at a later date, for example as part of our after-sales service. The amount of data collected depends on your use of the Website and the Website's functionalities.

In addition, we use cookies to recognize the User and offer them a personalized user experience, to remember their technical choices (for example, a language or a "shopping cart") and to detect and correct any errors on the Website. 5. How will my personal data be used ?

LumiPop collects your personal information in order to provide each User of our platform with a secure, optimal and personalized user experience. The collection of personal data may intensify as the User makes more intensive use of the platform and our online services. LumiPop reserves the right to suspend or cancel certain operations if data is missing, incorrect or incomplete.

Data processing is essential for the operation of the platform and related services. Processing is carried out exclusively for the following specific purposes:

  • Customer management: customer administration, order management, deliveries, invoicing, credit checks, support, complaints handling and newsletter dispatch.
  • Litigation management.
  • Protection against fraud and crime.
  • Personalized marketing and newsletters if you have expressly agreed to this. In this case, you are free to withdraw your consent at any time.

The user always provides the personal data himself/herself and can therefore exercise a certain degree of control. In the event of incomplete or apparently incorrect data, LumiPop reserves the right to temporarily or permanently postpone certain expected operations.

6. Who receives your personal data ?

Your personal data will be processed solely for internal use within LumiPop. Your personal data will not be sold, passed on or communicated to third parties, except with your explicit prior consent.

7. How long do we keep your personal data ?

Your data will be kept for a period of 10 years from the end of the relationship with the customer or prospect. The period starts from the last order, or the last connection to the customer account, or the last call to customer service, or the sending of an e-mail to customer service, or a click on a hypertext link in an e-mail sent by LumiPop, or the placing of products in the shopping basket without the purchase being completed, or a positive response to an e-mail asking whether the customer wishes to continue receiving commercial prospecting at the end of the five-year period. At the end of this period, the customer's or prospect's data will be anonymized.

Nonetheless, information used to establish proof of a right or contract, or kept to comply with a legal obligation, may be archived in accordance with the legal provisions in force.

8. What are your rights ?

8.1 Guarantee of lawful and secure processing of personal data

Your personal data will always be processed for legitimate purposes, as set out in article 5.

They are collected and processed in an appropriate, relevant and proportionate manner, and are kept for no longer than is necessary to achieve the objectives set.

8.2 Right of access

If you can prove your identity, you will have the right to obtain information about the processing of your data. This gives you the right to consult the purposes of the processing, the categories of personal data, the categories of recipients to whom the data has been sent, the criteria that determine the data retention period and the rights you can exercise regarding your data.

8.3 Right to rectify personal data

Inaccurate or incomplete data can be corrected. It is up to the User to make the necessary changes to his or her "User Profile". You can also contact us with a modification request.

8.4 Right to delete your personal data

You also have the right to have your personal data deleted in the following cases:

Your personal data are no longer required for the intended purpose ;

You withdraw your consent to the processing of your data and there is no other legal basis justifying the processing of your data ;

You have lodged a legal objection to the processing of your personal data;

Your data is processed unlawfully ;

Your data must be deleted in accordance with a legal obligation.

The deletion of data is mainly related to its visibility; it is possible that deleted data is stored temporarily.

8.5 Right to restrict processing

In certain cases, you have the right to restrict the processing of your personal data. In particular, if the accuracy of the data is contested, if the data is required for legal proceedings or for the time necessary for LumiPop to verify that you can validly exercise your right to erasure.

8.6 Right to object

You have the right at any time to object to the processing of your personal data for the purposes of 'direct marketing', profiling or for purposes that arise from the legitimate interests of the data controller. LumiPop will cease processing your personal data unless LumiPop can demonstrate compelling legitimate grounds for processing your personal data which override your right to object.

8.7 Right to data portability

You have the right to obtain from LumiPop any personal data you have provided to us in a structured, commonly used and machine-readable format. You also have the right to transfer this personal data to another data controller, unless this is technically impossible.

8.8 Right to withdraw your consent

You have the right to withdraw your consent at any time, for example if you have given it for direct marketing purposes.

9. How can you exercise your rights ?

If you wish to exercise your rights, you must send a written request and proof of identity by registered mail to LumiPop, 31 route Nationale 45130 Saint-Ay, France, or by email to infos@lumipop.com. We will reply as soon as possible, but no later than one (1) month after receipt of your request.
